Indikator Persekongkolan Lelang Proyek di Kediri

Kasus Jalan Wates – Plosoklaten Juga Divonis Miliaran

KEDIRI – Keputusan Komisi Pengawas Persaingan Usaha (KPPU) yang menjatuhkan denda hingga miliaran rupiah ke sejumlah rekanan proyek di Kabupaten Kediri, ditengarai tidak hanya di satu atau dua proyek. Ada sejumlah indikator  yang terungkap di persidangan, terkait lelang proyek peningkatan dan pembangunan jalan itu, baik secara vertical atau antara rekanan dengan Pokja ULP dan horizontal atau antar PT rekanan proyek.

Pada indicator yang terungkap di data persidangan KPPU itu, indicator persekongkolan antara lain adanya sejumlah nama pemilik yang sama di perusahaan yang berbeda, yang mengajukan penawaran tender. Indikasi nama perusahaan berbeda, tetapi dalam kendali yang sama. Ditemukan indikasi nama-nama personil yang sama di perusahaan yang berbeda.

Gambaran umum terkait adanya persekongkolan itu, juga terlihat pada putusan KPPU di kasus serupa, tapi berbeda, yaitu jalan Wates-Plosoklaten. Ada beberapa PT yang sama, yang diputus KPPU terlibat dugaan persekongkolan. Bedanya, putusan tertinggi adalah denda Rp 2,3 miliar lebih, yan dijatuhkan ke PT. Kediri Putra. Sedangkan PT yang lain rata-rata didenda Rp 1 miliar.

Mantan Ketua Pokja ULP Kediri, Surani, yang juga ikut direkomendasi untuk diberi sanksi, saat mau dikonfirmasi melalui saluran whatsapp, sampai berita ini ditulis, belum memberikan jawaban. Begitu juga dengan Damas Danur Rendra, ULP Pemkab Kediri.

Kasus-kasus ini, masih dalam proses kasasi di Mahkamah Agung, karena pihak terlapor masih berupaya hukum yang lebih tinggi, setelah diputus KPPU RI. (mam)

The company name indication is different, but under the same control. There were indications of the names of the same personnel in different companies.
The general description regarding the conspiracy is also seen in the KPPU decision in a similar but different case, namely the Wates-Plosoklaten road. There were several universities which were the same, which were decided by KPPU to be involved in the suspicion of conspiracy. The difference is, the highest verdict is a fine of more than Rp. 2.3 billion, which was imposed on PT. Kediri Putra. Meanwhile, other universities were fined an average of Rp. 1 billion.
