Sungai  Buntung Hilang, Tanpa Kompensasi?

KEDIRI – Panitia Khusus (Pansus) DPRD Kota Kediri, akhirnya ‘Angkat Tangan’ terkait permintaan Pemkot agar lahan Sertifikat Hak Pakai (SHP) 33 di Kelurahan Balowerti, Kota Kediri, diserahkan ke pengembang PT. SK Bangun Persada, pimpinan Upoyo Sarjono.  Untuk memutuskan apakah permintaan Pemkot bahwa SHP 33  disetujui diserahkan ke pengembang atau tidak, diserahkan ke paripurna dewan. “Disetujui atau tidak (SHP 33 diserahkan ke pengembang,red), diserahkan ke paripurna dewan“ ujar Mistiani, ketua Pansus SHP 33 DPRD Kota Kediri.

Seperti diberitakan, Pemkot Kediri mengajukan surat persetujuan pelepasan tanah SHP 33 di Kelurahan Balowerti seluas 3.510 m2 ke pengembang PT. SK Bangun Persada. Namun, di internal Pansus itu suara terbelah. Ada yang berusaha menyetujui dan ada yang menolak.

Saat ditanya soal suara anggota Pansus yang terbelah, Mistiani membenarkan, memang ada anggota Pansus yang menyetujui pelepasan dan ada yang tidak menyetujui. Sehingga Pansus tidak bisa membuat keputusan bulat. Akhirnya disepakati keputusan diserahkan ke paripurna.

Menurut Mistiani, berdasarkan dokumen dokumen yang diserahkan Pemkot ke Pansus, tidak ada dokumen yang menguatkan sebagai dasar untuk menyetujui pelepasan SHP 33 itu. Pertama, pada perjanjian No. 590 / 1352 / 419.44 / 2014, antara Pemkot Kediri dengan PT. SK Bangun Persada, tidak menyebut bahwa SHP 33 sebagai bagian dari perjanjian. Kedua, pada gugatan Pemkot Kediri ke PT. Dhoho Nauli, mulai putusan Pengadilan Negeri (PN) sampai Mahkamah Agung (MA), hanya menyebut bahwa antara Pemkot dengan PT Dhoho Nauli sudah tidak ada masalah. Selain itu, pada gugatan itu, PT. SK Bangun Persada tidak masuk sebagai bagian dari para pihak.  “Tidak ada satu klausul pun bahwa Pemkot harus menyerahkan SHP 33,”tandas Mistiani.

Sementara itu, di sisi lain proses ruilslag dengan PT. SK Bangun Persada ini, juga masih menyisakan sejumlah pertanyaan yang mengganjal di sebagian warga. Misalnya, terkait hilangnya Sungai Buntung, yang dulu membujur dari selatan ke utara, dengan lebar sekitar 5 m dan panjang sekitar 200 m atau total sekitar 1000 m2. “Dulu, di samping saluran air itu ada jalan, becak bisa lewat. Ditambah dengan luas saluran airnya. Ya kira-kira sekitar 5 m,”ujar salah seorang warga, yang ditemui di sekitar lokasi.

Hilangnya Sungai Buntung ini, bagaimana statusnya, juga belum jelas. Apakah ada kompensasi atau tidak, termasuk yang diganti tanahnya atau tidak, ada alih fungsi atau tidak, belum jelas. “Kalau tidak ada apa-apanya, berarti Upoyo  (PT. SK Bangun Persada,red) bisa menikmati tanah saluran air dan jalan itu secara gratis dari Pemkot. Lumayan lho, bisa 1000 m2,”tambah sumber itu.

Saat kediripost ke lokasi, pada ujung Sungai Buntung di sebelah utara kompleks Persada itu, masih terlihat bekas bangunan plengsengan sungai dari batu di sebelah sisi kiri dan kanan. Hanya, sungai itu kini ditimbun dengan tanah dan ditanami pohon papaya oleh petani sekitar, karena jalur saluran airnya sudah mati. (mam)
