Diprediksi, Politik Selesai, Hukum Berhenti
KEDIRI – Pemeriksaan aparat penegak hukum, baik kejaksaan maupun kepolisian, mulai berhembus isu-isu kurang sedap di masyarakat. Yakni, pemeriksaan itu lebih bersifat politis, bukan proses pemeriksaan dengan tujuan penegakan hukum murni. Sehigga diprediksi, jika momen politik berlalu, kasus-kasus yang diperiksa itu akan menguap atau tidak ada kejelasan kepastian hukumnya.

“Isu – isu pemeriksaan dugaan penyimpangan itu lebih bersifat politis, memang beredar di masyarakat. Isu ini penting untuk segera disikapi dan dibuktikan kebenarannya. Yang bisa membuktikan isu itu benar atau tidak, ya penegak hukum itu sendiri, karena mereka yang memiliki kewenangan melakukan pemeriksaan,”ujar Masduki, ketua Jaringan Masyarakat dan Santri (Jamasan) Kediri.
Seperti diberitakan, sejumlah SKPD di lingkungan Pemkab Kediri, ramai-ramai diperiksa penegak hukum dengan dugaan penyimpangan penggunaan keuangan negara. Antara lain Dinas Kominfo, Bagian Hukum, Kesbangpolinmas, dan sebagainya. Hanya saja, belum ada yang ditetapkan sebagai tersangka pada kasus – kasus itu.
Menurut Masduki, isu soal pemeriksaan itu lebih bersifat politis, membuat tingkat kepercayaan masyarakat terhadap hukum akan semakin melemah. Bagi terperiksa, juga tidak akan memunculkan efek jera, malah mereka akan lebih santai dan mengutamakan gerakan lobi dibanding memperbaiki kinerjanya. “Kalau lobi lebih dikedepankan dibanding proses hukumnya, maka akan muncul kesan penegakan hukumnya menjadi bias. Mestinya harus dipisahkan, hukum ya hukum, politik ya politik, bukan hukum lobi-lobian,”tandas Masduki.
Masduki berharap, isu-isu yang berhembus di masyarakat secara meluas itu tidak terbukti, agar tingkat kepercayaan masyarakat terhadap hukum tidak hilang. Isu-isu seperti itu memang sulit dibuktikan secara faktual, tetapi bisa dirasakan dan ditafsirkan melalui indikator-indikator yang muncul. “Masyarakat tidak akan mampu membuktikan benar atau salahnya isu itu. Sulit dibuktikan. Masyarakat hanya percaya, setengah percaya, dan tidak percaya. Yang bisa membuktikan benar atau tidaknya isu itu, nanti di proses akhir pemeriksaan. Misalnya, kasus itu ternyata hilang begitu saja tanpa kejelasan atau diteruskan dengan kepastian hukum. Itu akan menjadi bagian dari indikator yang dibaca dan ditafsiri masyarakat,”jelasnya. (mam)

Namely, the examination is more of a political nature, not an examination process with the aim of pure law enforcement. So that if the political moment passes, the cases being examined will evaporate or the legal certainty will not be clear. “The issues of investigating alleged irregularities are more political in nature, indeed circulating in the community. This issue is important to immediately address and prove the truth. The ones who can prove the issue are true or not are the law enforcers themselves, because they have the authority to carry out the investigation, ”said Masduki, chairman of the Kediri Community and Santri Network (Jamasan).
As reported, a number of SKPDs within the Kediri Regency Government are being questioned by law enforcers for alleged irregularities in the use of state finances. Among others, the Ministry of Communication and Information, Legal Affairs, Kesbangpolinmas, and so on. However, no one has been named as a suspect in those cases.
According to Masduki, the issue of the questioning was more political in nature, making the level of public trust in the law weaker. For those who are examined, it will not cause a deterrent effect, they will be more relaxed and prioritize lobbying rather than improving their performance. “If lobbying takes precedence over the legal process, there will be an impression that law enforcement is biased. It should be separated, law is law, politics is politics, not lobbying, ”Masduki said.
Masduki hopes that the issues that spread in society at large are not proven, so that the level of public trust in the law is not lost. Such issues are difficult to prove factually, but they can be felt and interpreted through emerging indicators. “The public will not be able to prove whether the issue is right or wrong. It’s hard to prove. People only believe, half believe, and don’t believe. The one who can prove whether the issue is true or not will be in the final examination process. For example, the case simply disappeared without clarity or was continued with legal certainty. That will be part of the indicators read and interpreted by the community, “he explained. (mam)
