KEDIRI – Nasib Suherman, mantan Camat Kras, kini di ujung tanduk. Setelah divonis oleh majelis hakim Pengadilan Negeri (PN) Kabupaten Kediri dengan hukuman 15 bulan, kini dia terancam ‘dipecat’ atau diberhentikan dari Aparatur Sipil Negara (ASN) atau PNS. Namun, nasib Suherman ini masih akan ditentukan pada peradilan tingkat banding atau yang lebih tinggi. Karena dia melakukan banding terhadap putusan PN Kabupaten Kediri itu.
SUHERMAN : Status ASN-nya menunggu keputusan pengadilan yang berkekuatan hukum tetap
Ada 3 kemungkinan yang bisa terjadi pada Suherman. Pertama, jika di peradilan tingkat banding, yaitu Pengadilan Tinggi (PT) Jawa Timur membebaskan dari segala tuduhan, maka status ASN Suherman bisa dikembalikan. Kedua, jika di PT diputus hukuman di bawah 2 tahun, seperti di PN Kabupaten Kediri, Suherman bisa diberhentikan secara hormat. Jika diputus di atas 2 tahun, bisa diberhentikan secara tidak hormat.
Solihin, Kepala Badan Kepegawaian Daerah (BKD) Kabupaten Kediri, menjelaskan membenarkan adanya kemungkinan Suherman diberhentikan dari ASN, baik secara terhormat maupun tidak terhormat. Tergantung dari putusan pengadilan nantinya, yang sudah memiliki kekuatan hukum tetap. “Tergantung itu putusannya. Jika bebas, dikembalikan haknya. Jika kurang dari 2 tahun, diberhentikan dengan hormat. Jika lebih dari 2 tahun, diberhentikan dengan tidak hormat. Dasarnya, PP No. 11 tahun 2017 tentang Manajemen PNS,”ujar Solikin.
Diberhentikan dengan hormat atau tidak hormat, lanjut Solikin, memiliki konsekwensi yang berbeda. Jika diberhentikan dengan hormat, masih berhak mendapatkan pensiun. Tapi jika diberhentikan secara tidak hormar, tidak memiliki hak pensiun. “Posisi sekarang, sejak ditahan beberapa waktu lalu, dia diberhentikan sementara dari PNS,”tandas Solikin.
Seperti diberitakan, Suherman, mantan Camat Kras, dilaporkan ke polisi karena diduga melakukan penipuan / penggelapan terkait pengisian perangkat desa, saat dia masih menjabat sebagai Camat Kras. Namun, Suherman menyebut itu utang piutang untuk melunasi pembayaran pajak. Suherman, kini dalam status tahanan kota. (mam)
Suherman Threatened to be “fired” from ASN

After being sentenced by a panel of judges to the Kediri District Court (PN) with a sentence of 15 months, he is now threatened with being “fired” or dismissed from the State Civil Service (ASN) or PNS. However, Suherman’s fate will still be determined at the court of appeal level or higher. Because he appealed against the decision of the Kediri District District Court.
There are 3 possibilities that could happen to Suherman. First, if the court at the appellate level, namely the East Java High Court (PT) acquits all charges, then Suherman’s ASN status can be restored. Second, if a sentence of less than 2 years is decided at the PT Kediri District Court, Suherman can be dismissed with respect. If it is terminated after 2 years, it can be dishonorably discharged.
Solihin, Head of the Regional Civil Service Agency (BKD) of Kediri Regency, explained that he confirmed the possibility of Suherman being dismissed from ASN, both respectfully and dishonorably. It depends on the court’s decision later, which already has permanent legal force. “That depends on the verdict. If free, the rights are returned. If less than 2 years, dismissed with respect. If it is more than 2 years old, will be dishonorably discharged. Basically, PP No. 11 of 2017 concerning the Management of Civil Servants, “said Solikin.
Being dismissed with respect or disrespect, continued Solikin, had different consequences. If he is honorably discharged, he is still entitled to a pension. But if it is dismissed in a respectful manner, it will not have the right to retire. “His current position, since being detained some time ago, has been temporarily suspended from civil servants,” said Solikin.
As reported, Suherman, the former head of the Kras sub-district, was reported to the police for allegedly committing fraud / embezzlement related to charging village officials, while he was still the head of the Kras sub-district.
