Pengganti Fasum, yang Bangun Pemkot?
KEDIRI – Kegaduhan di Pansus DPRD Kota Kediri, terkait keinginan Pemkot agar DPRD segera menyetujui penyerahan lahan SHP 33 Kelurahan Balowerti ke PT. SK Bangun Persada, pimpinan Upoyo Sarjono alias Suk Wan, ternyata juga menyisakan pro kontra di masyarakat, selama bertahun – tahun. Sebagian warga menolak ruilslag itu. Sebab, pada proses ruilslag tanah sebelumnya dengan PT. SK. Bangun Persada, beberapa konsekwensi yang seharusnya diselesaikan, hingga kini belum selesai.

“Misalnya gorong – gorong saluran air yang sebelumnya ada, itu ditutup. Katanya mau diganti saluran airnya, tapi sampai sekarang tidak jelas. Malah, sempat ada kabar bahwa jika ada pembuatan gorong-gorong, nanti Pemkot yang akan membangun? Nahhh… kalau seperti itu kan seperti jadi akal-akalan,”ujar Sugeng Hari Adi, salah satu warga Kelurahan Balowerti, saat ditemui di rumahnya.

Seperti diberitakan, Pemkot Kediri meminta agar Pansus DPRD Kota Kediri segera menyetujui penyerahan lahan SHP 33 yang diminta oleh PT. SK Bangun Persada. Namun, Pansus belum berani memberi persetujuan, antara lain karena dalam perjanjian tukar menukar atau ruilslag tanah Pemkot tahun 2014, lahan SHP 33 tidak masuk dalam perjanjian. Pansus DPRD sendiri, kini masih deadlock karena perbedaan pendapat di antara anggota Pansus dan lahan SHP 33 tidak termasuk dalam perjanjian tahun 2014 ruilslag dengan PT. SK Bangun Persada.
Menurut Sugeng, dalam proses ruilslag lahan mestinya dilakukan secara fair dan transparan, mulai tanah pengganti yang harus sudah atas nama PT SK Bangun Persada, penggantian fasilitas umum yang hilang, dan sebagainya. Sehingga tidak menimbulkan kecurigaan dan ketidakpuasan masyarakat. “Dulu saat proyek peningkatan jalan juga begitu, seharusnya yang membangun pengembang, tapi ternyata rekanan itu mendapat proyek dari Pemkot. Banyak lah pokoknya masalah yang belum tuntas,”tandas Sugeng.
Informasi yang dikumpulkan kediripost, lahan SHP 33 itu sendiri sebenarnya sudah diajukan ruilslag oleh PT. Dhoho Nauli pimpinan Amin Junaidi pada tahun 2003. Rencananya, PT. Dhoho Nauli akan membangun rumah sakit. DPRD Kota Kediri tahun 2003 sudah memberi persetujuan ruilslag itu dan dilakukan nota kesepahaman atau MoU dan tanah pengganti sudah disediakan. Pada 2006, Pemkot resmi melepas lahan, termasuk SHP 33, ke PT Dhoho Nauli.
Namun dengan alasan beberapa beberapa kewajiban PT Dhoho Nauli belum dituntaskan, termasuk setoran kompensasi uang ke Kasda. Sementara, PT. Dhoho Nauli mengaku belum setor uang ke Kasda, karena minta nomor rekening berkali – kali, tidak diberi. Sehingga tidak bisa setor. Tahun 2014 Pemkot Kediri menggugat PT. Dhoho Nauli dan memenangkan perkara. Proses peradilan ini, berjalan hingga ke Mahkamah Agung dan baru tuntas 2016. Perkara ini dimenangkan Pemkot Kediri.
Pada tahun yang sama dengan gugatan Pemkot ke PT. Dhoho Nauli berjalan, tahun 2014, Pemkot Kediri melakukan penandatanganan perjanjian ruilslag dengan PT. SK Bangun Persada. Namun dalam perjanjian itu, lahan SHP 33 tidak masuk dalam perjanjian. Usai menang di MA, entah mengapa, Pemkot mengajukan surat ke DPRD Kota Kediri dan berusaha lahan SHP 33 itu diserahkan ke PT. Nahhh… if it’s like that it’s like a trick, ”said Sugeng Hari Adi, a resident of Balowerti Village, when met at his house.
As reported, the Kediri City Government requested that the Special Committee for the DPRD of Kediri City immediately approve the handover of the 33 SHP lands requested by PT. SK Bangun Persada. However, the Special Committee has not dared to give approval, partly because in the 2014 municipal government land swap agreement or land bill, the 33 SHP land was not included in the agreement. The DPRD Special Committee itself is still in a deadlock because of differences of opinion between members of the Special Committee and SHP 33 land was not included in the 2014 RUILLAG agreement with PT. SK Bangun Persada.
According to Sugeng, in the process of land planning, it should be carried out in a fair and transparent manner, starting from the replacement land which must already be in the name of PT SK Bangun Persada, replacement of lost public facilities, and so on. So that it does not cause public suspicion and dissatisfaction. “Previously when the road improvement project was the same, it should have been the developer building, but it turns out that the partner received a project from the municipal government. There are many issues that have not been resolved, ”said Sugeng.
The information collected by kediripost shows that the 33 SHP land itself has actually been submitted ruilslag by PT. Dhoho Nauli led by Amin Junaidi in 2003. The plan is that PT. Dhoho Nauli will build the hospital. In 2003, the Kediri City DPRD approved the draft and a memorandum of understanding was carried out or an MoU and replacement land was provided. In 2006, the municipal government officially released land, including SHP 33, to PT Dhoho Nauli.
However, on the grounds that several obligations of PT Dhoho Nauli have not been completed, including the payment of cash compensation to the Kasda. Meanwhile, PT. Dhoho Nauli admitted that he had not yet deposited money to Kasda, because he asked for an account number many times, he was not given it. So it can’t be deposited. In 2014 the Kediri City Government sued PT. Dhoho Nauli and won the case. This judicial process, running up to the Supreme Court, was only completed in 2016. This case was won by the Kediri City Government.
In the same year as the City Government’s lawsuit against PT. Dhoho Nauli is running, in 2014, Kediri City Government signed a ruilslag agreement with PT. SK Bangun Persada. However, under the agreement, the 33 SHP land was not included in the agreement. After winning in the Supreme Court, for some reason, the municipal government submitted a letter to the Kediri City DPRD and tried to hand over the 33 SHP land to PT. SK Bangun Persada. (mam)
