SIAPKAN SAKSI MERINGANKAN : Prayoga S.H dan Eryck Andikha S.H, kuasa hukum Supadi
KEDIRI- Dua saksi kunci kasus dugaan penggunaan gelar tidak sah oleh bakal calon Bupati Kediri, Supadi, yaitu notaris Eko Sunu Djatmiko S.H, dan Trisnawati S.H, tidak hadir dalam persidangan lanjutan di Pengadilan Negeri (PN) Kabupaten Kediri, Rabu (29/4/2020). Kesaksian dua notaris itu, hanya dibacakan oleh JPU Iskandar S.H. Sehingga tidak sempat terjadi tanya jawab antara Hakim, penasehat hukum, dan JPU dengan para saksi itu. “Kami kecewa dengan ketidakhadiran dua dua saksi notaris itu, karena kesempatan untuk membuka seluas-luasnya data-data dan fakta di persidangan menjadi kurang leluasa,”ujar Prayoga S.H, didampingi Eryck Andhika S.H, penasehat hukum Supadi, usai persidangan.
Seperti diberitakan sebelumnya, Supadi, bakal Calon Bupati Kediri, dilaporkan polisi karena diduga menggunakan gelar akademik secara tidak sah. Kasus ini dalam proses disidangkan di PN Kabupaten Kediri dengan JPU Tomy Marwanto S.H, dan Iskandar S.H. Sidang dipimpin oleh majelis hakim Guntur Pambudi S.H, Melina Nawang Wulan S.H, dan M. Fahmi Hary Nugroho S.H. Sedangkan Supadi didampingi oleh penasehat hukum Prayogo Laksono S.H dan rekan.
Dua Notaris yaitu Eko Sunu Djatmiko S.H dan Trisnawati S.H, dinilai sebagai saksi kunci karena dua alat bukti utama yang digunakan dalam kasus ini adalah akta yang dikeluarkan oleh notaris Eko Sunu dan Trisnawati, yang dengan jelas menyebut Supadi Sarjana Ekonomi, bukan Supadi, SE. Ada kemungkinan, penyebutan Sarjana Ekonomi itu merupakan asumsi notaris sendiri bahwa SE di belakang nama Supadi adalah singkatan dari Sarjana Ekonomi, bukan singkatan nama. Sementara di berkas-berkas lain, baik di KK maupun KTP yang berubah-ubah, hanya disebut Supadi, SE. “Bisa saja terjadi human error seperti keterangan saksi dari Dispendukcapil sebelumnya,”tandas Prayoga.
Sejumlah awak media mendatangi ke kantor Eko Sunu untuk mendapatkan konfirmasi terkait kasus tersebut. Namun yang bersangkutan belum bisa ditemui dan hanya ditemui oleh stafnya. Sidang akan dilanjutkan minggu depan dengan agenda mendengarkan saksi ahli dari JPU dan saksi meringankan yang diajukan oleh tim penasehat hukum Supadi. (mam)
Key Notary Witness Dare Not Present?
KEDIRI- Two key witnesses in the alleged illegal use of the title by prospective Kediri Regent candidates, Supadi, namely the notary Eko Sunu Djatmiko SH, and Trisnawati SH, did not attend the follow-up trial at the Kediri District Court (PN), Wednesday (29/4 / 4 / 2020). The testimony of the two notaries was only read out by the Prosecutor Iskandar S.H. So there was no question and answer session between Judges, legal advisors, and prosecutors with the witnesses. “We are disappointed with the absence of the two notary witnesses, because the opportunity to open as wide as possible the data and facts at the trial has become less flexible,” said Prayoga S.H, accompanied by Eryck Andhika S.H, Supadi’s legal advisor, after the trial.
As reported previously, Supadi, a candidate for the Regent of Kediri, was reported by the police for allegedly using an academic degree illegally. This case is currently being tried in Kediri District Court with prosecutors Tomy Marwanto S.H, and Iskandar S.H. The trial was chaired by a panel of judges Guntur Pambudi S.H, Melina Nawang Wulan S.H, and M. Fahmi Hary Nugroho S.H. While Supadi was accompanied by legal counsel Prayogo Laksono S.H and colleagues.
Two Notaries, Eko Sunu Djatmiko S.H and Trisnawati S.H, were assessed as key witnesses because the two main pieces of evidence used in this case were the deed issued by the notary Eko Sunu and Trisnawati, who clearly mentioned Supadi Bachelor in Economics, not Supadi, SE. It is possible, the mention of the Bachelor of Economics is a notary’s own assumption that the SE behind the name Supadi is an abbreviation of Bachelor of Economics, not an abbreviation of the name. While in other files, both in KK and KTP that change, it is only called Supadi, SE. “Human error can occur as witnesses from Dispendukcapil said earlier,” said Prayoga.
A number of media crews came to Eko Sunu’s office to get confirmation regarding the case. But the person concerned could not yet be found and was only met by his staff. The trial will be continued next week with the agenda of listening to expert witnesses from the prosecutor and defense witnesses proposed by Supadi’s legal advisory team. (mam)
