Mencurigakan, Pemkot Terkesan ‘Ngotot’ Lepas Lahan

KEDIRI – Kesan bahwa Pemkot Kediri ‘mendesak’ agar Pansus DPRD Kota Kediri segera menyetujui melepas tanah milik Pemkot dengan Sertifikat Hak Pakai (SHP) 33 di Kelurahan Balowerti ke pengembang PT. SK. Bangun Persada atau rencana untuk perumahan Persada II, memunculkan sejumlah pertanyaan mencurigakan di sebagian masyarakat. Mengapa Pemkot terkesan ‘ngotot’ agar tanah itu segera diserahkan ke pengembang?  Sebenarnya siapa yang butuh ruilslag,  Pemkot atau pengembang? Ada apa sebenarnya?  Pembahasan di Pansus DPRD sendiri, kini masih deadlock. Sikap dewan terpecah, ada yang setuju dan ada belum mau menyetujui pelepasan lahan SHP 33 itu.  

Terkait lahan SHP 33 yang sedang dibahas Pansus DPRD Kota Kediri ini, berdasarkan perjanjian tukar menukar atau ruilslag antara Pemkot Kediri dengan PT SK Bangun Persada, No. 590 / 1352/419.44/2014,  ternyata lahan SHP 33 tidak tercantum dalam perjanjian tukar menukar atau tidak termasuk di dalam perjanjian.

BELUM DILEPAS, SUDAH DIURUK Lahan SHP 33 milik Pemkot, Kediri tepat di belakang perumahan Persada Asri Kelurahan Balowerti 

Di sisi lain, fakta lapangan. Lahan SHP 33 yang masih proses dimintakan untuk disetujui DPRD Kota, ternyata secara praktis terkesan seakan ‘sudah dalam penguasaan’ pengembang. Indikasi itu, antara lain pertama, lahan SHP 33 sudah diuruk. Informasinya, tanah itu diuruk sudah sekitar 3 tahun lalu.

Kedua, di areal SHP 33 sudah dibangun akses jalan menuju areal yang rencananya akan dibangun perumahan persada 2. Belum jelas, apakah ada ‘perjanjian lain’ antara Pemkot dan PT. SK Bangun Persada, sehingga tanah yang masih dalam penguasaan Pemkot Kediri, boleh diuruk pengembang dan pengembang boleh membuat akses jalan melalui lahan Pemkot, sehingga seakan akan lahan itu sudah dikuasai pengembang.

Ketiga, dengan kondisi lahan sudah teruruk koral, batu bekas bangunan, dan sebagainya, Pemkot tidak bisa memanfaatkan lahan itu. Misalnya untuk disewakan ke petani atau lainnya. Karena tidak bisa ditanami padi lagi. Sehingga potensi pendapatan daerah menjadi hilang selama beberapa tahun.

Sementara itu, Kepala Dinas Kominfo Kota Kediri, Apip Permana, saat dikonfirmasi terkait realitas lahan SHP 33 ini, belum memberikan jawaban. Saat dihubungi melalui telepon selular, tidak diangkat. Pertanyaan kediripost yang dikirim melalui saluran whatsApp, juga belum dijawab. (mam)

KEDIRI – The impression is that the Kediri City Government “urges” the Special Committee for the DPRD of Kediri City to immediately agree to release land belonging to the City Government with a Certificate of Use Rights (SHP) 33 in Balowerti Village to the developer of PT. SK. Bangun Persada or plans for Persada II housing, raises a number of suspicious questions in some communities. Why does the municipal government seem “insistent” so that the land is immediately handed over to the developer? Actually who needs ruilslag, municipal government or developer? What’s the matter? The discussion at the DPRD Special Committee itself is still a deadlock. The council’s attitude was divided, there were those who agreed and some did not want to approve the release of the 33 SHP land.
Regarding SHP 33 land which is being discussed by the Special Committee for the DPRD of Kediri City, based on an exchange agreement or rashlag between Kediri City Government and PT SK Bangun Persada, No. 590/1352 / 419.44 / 2014, it turns out that the 33 SHP land was not listed in the exchange agreement or was not included in the agreement.
On the other hand, field facts. The SHP 33 land, which is still being requested for approval by the City Council, in practice seems as if it is “under the control” of the developer. The first indications include: first, the land for SHP 33 has been landfilled. According to the information, the land was already filled 3 years ago.
Second, in the SHP 33 area a road access has been built to the area where Persada housing is planned. 2. It is not clear, whether there is any “other agreement” between the City Government and PT. The Bangun Persada Decree, so that the land which is still under the control of the Kediri City Government, may be subordinated by the developer and the developer may make road access through the City Government’s land, so that it appears as if the land has been controlled by the developer.
Third, with the condition of the land already degraded by coral, used stones, and so on, the City Government cannot take advantage of the land. For example, for rent to farmers or others. Because it can’t be planted with rice anymore. So that the potential for regional income has been lost for several years.
Meanwhile, the Head of the Kediri City Communication and Information Service, Apip Permana, when confirmed regarding the reality of the 33 SHP land, has not provided an answer.
