ilslag tanah yang sudah diajukan sejak 2009 lalu, yaitu Sertifikat Hak Pakai (SHP) 33. DPRD Kota Kediri, sudah membentuk Pansus kaitan ruilslag itu, tetapi saat ini sedang diskors karena adanya perbedaan pandangan di antara anggota Pansus. Masalah ruilslag ini sudah berkali-kali dibahas, tapi selalu mentok karena ada beberapa persoalan yang dinilai belum tuntas.

Berdasarkan data yang dikumpulkan kediripost, pada pengajuan ruilslag oleh PT. SK Bangun Persada itu, ada beberapa asset Pemkot, antara lain eks tanah kas Desa Banjaran di Balowerti, eks tanah kas Desa Balowerti dan eks tanah kas Desa Semampir, yang secara total sebanyak 16 bidang, dengan luas 76.361 m2 dengan pada 2012 adalah Rp 1,3 miliar lebih. Belum ada penjelasan, nilai Rp 1,3 miliar itu berdasarkan apa, NJOP atau harga umum.

Sedangkan PT. SK Bangun Persada menyiapkan rencana tanah pengganti di berbagai tempat yang berpencar, seluas 102.631 m2 dengan nilai NJOP tahun 2012 adalah Rp 4,9 miliar lebih. Untuk harga umum tanah pengganti itu, diklaim senilai Rp 14,1 miliar lebih.

Namun dalam perjalanannya, muncul berbagai masalah, antara lain informasi bahwa asset tanah SHP 33 itu sudah pernah diajukan dan dilepas ke PT. Dhoho Nauli. Beberapa lama kemudian, muncul info bahwa ternyata di keputusan Pansus DPRD sebelumnya, tidak mencantumkan SHP 33 ke PT Dhoho Nauli.

Selain itu, muncul juga asumsi tentang perbedaan nilai asset. Setelah dilakukan penilaian oleh Masyarakat Profesi Penilai Indonesia (MAPI) tahun 2019, termasuk di dalamnya SHP 33, nilai asset Pemkot itu Rp 19 miliar lebih. Sedangkan nilai tanah pengganti hanya Rp 15 miliar lebih. Sehingga nilai tanah pengganti masih kurang Rp 3 miliar lebih. Sehingga PT. SK Bangun Persada harus menyetor kekurangan Rp 3 miliar lebih itu ke Pemkot, yang dilakukan pada Mei 2019.

Isu yang berkembang, berkaitan dengan proses ruilslag ini, masih banyak memunculkan pertanyaan di sebagian masyarakat, antara lain terkait jarak tanah pengganti. Kedua, lokasi lahan itu masuk area LP2B (Lahan Pertanian Pangan Berkelanjutan) yang harus dilindungi. Ketiga, sertifikat rencana tanah pengganti itu masih atas nama pemilik lahan semula, bukan atas nama PT. SK Bangun Persada. Ke empat, sertifikat yang diserahkan ke Pemkot untuk lahan pengganti, sebagian masih berupa foto copy sertifikat.

“Kalau ruislag dengan PT Dhoho Nauli dulu, sertifikat yang diserahkan ke Pemkot sudah atas nama PT. Dhoho Nauli lalu diganti atas nama Pemkot Kediri sebagai asset Pemkot. Karena ‘gagal’ ruilslag di SHP 33, Pemkot mengembalikan tanah itu ke atas nama Dhoho Nauli. Kalau sertifikat belum atas nama Pemkot, di belakang hari bisa saja muncul berbagai masalah. Jadi ruilslag itu semua harus clear di awal,”ujar sumber kediripost yang tidak mau disebut namanya.

Sementara itu, Mistiani, ketua Pansus DPRD Kota Kediri, mengakui Pansus terkait ruilslag dengan PT SK Bangun Persada itu masih belum tuntas, masih diskors. Dia membenarkan adanya surat dari Pemkot Kediri yang meminta persetujuan pelepasan SHP 33 itu. “Tapi  apa pun nanti tergatung rekomendasi dari hasil pansus . Kita tunggu saja,”kata politisi dari Partai Demokrat ini. (mam)

After an assessment was carried out by the Indonesian Professional Appraisal Society (MAPI) in 2019, including SHP 33, the City Government’s asset value was more than Rp 19 billion. Meanwhile, the value of the replacement land is only more than Rp 15 billion. So that the value of the replacement land is still less than Rp. 3 billion. So that PT. The Bangun Persada decree must deposit the shortfall of Rp. 3 billion more to the City Government, which will be carried out in May 2019.
A growing issue related to this ruilslag process still raises many questions in some communities, including the distance of replacement land. Third, the certificate of the replacement land plan is still in the name of the original land owner, not in the name of PT. SK Bangun Persada.
